In compliance with clause (b) of sub-section (1) of  Section - 4 of the Right to Information Act, 2005 Law and Judicial Department, Government of Mizoram hereby published this Information Booklet for the convenience of the general public on this the 5th day of May, 2017.

 

Introduction

 

                        Law and Judicial Department was established in the year 1972 as soon as Mizoram became a Union Territory. Law and Judicial Department has been functioning as Secretariat and also akin to Directorate having separate budget provision. Parliamentary Affairs department used to be a part of Law and Judicial Department but it was bifurcated from Law and Judicial Department by creating a new department called “Parliamentary Affairs Department” on 30.10.1995. Consumer Affairs was also a part of Law and Judicial Department which was later on allotted to Food and Civil Supplies Department as “Department of Food, Civil Supplies and Consumer Affairs” on 17.11.2004. Separation of Judiciary from Executive has been implemented in Mizoram with effect from 16.6.2005. Before separation of Judiciary from Executive, Law and Judicial Department administers all our District offices directly and after separation, Law and Judicial Department has no direct control over District offices but they are now under the administrative control of the Gauhati High Court. However, the department still has a number of important role to play in the development and functioning of the subordinate judiciary in close coordination with the Gauhati High Court. The main function of Law  and  Judicial   Department can be categorised into three viz. legislation of  various kinds of law including vetting thereof, giving legal advice to all departments of the government, and monitoring of all court cases where government is a party from the bottom to the top court.    

 

With reference to Section – 4 (1) (b) (i) of the RTI Act, 2005

 

             1. 1       Organisational  Set Up

 

                       Law and Judicial Department is headed by  Secretary         -cum- Legal Remembrancer who is assisted by Joint Secretary                 -cum- Joint Legal Remembrancers, Two Deputy Secretaries -cum-Deputy Legal Remembrancers, Two Under Secretaries -cum- Assistant Legal Remembrancers, One Superintendent and three Law Officers and supporting staff.

When Separation of Judiciary was implemented by a notification dt. 16.6.2005, the State of Mizoram is divided into two Judicial Districts namely Aizawl Judicial District headed by the District & Sessions Judge which comprises of the administrative districts of

               (1) Aizawl

               (2) Mamit

               (3) Champhai

               (4) Kolasib

                (5) Serchhip

 

and the other one is Lunglei Judicial District headed by the District & Sessions Judge which  comprises of the administrative districts of

 

(1) Lunglei.

(2) Lawngtlai.

(3) Siaha.

 

                        Aizawl and Lunglei administrative District is headed by the respective District & Sessions Judge while rest of the administrative districts are headed by Chief Judicial Magistrates supported by other officers and staff.

 

Besides these, Law and Judicial Department is having outlying offices as under :

 

(1) Mizoram State Legal Services Authority

(2) Registrar General of Marriages

(3) Mizoram State Law Commission

 

Necessary steps are also currently underway to establish the following offices :

 

(1) Fast Track Court

(2) Gramnayalayas.

 

 

1.2       Its functions

 

1)    Law and Judicial Department is the Nodal department for handling court cases in which the State Government is a party, 

and its duty of all  is to safeguard the interest of State Government in the Courts of Law.

2)         Vetting of Acts, rules, MOU, contract agreement of all departments of the State of Mizoram.

3)         To aid and advice the Government and other Department on all legal matter.

4)         To consider the proposals for legislation for the consideration of the Government.

5)         To draft legislations for giving effect to the decisions of the Government.

6)         To prosecute all litigation for and on behalf of the State Government.

             7)         To make proposals for legal reforms to the Government.

8)         To bring out and published from all Acts, rules, notifications and update them from time to time.

9)         To formulate scheme for giving legal aid to weaker sections of the society.

10)       Law and Judicial Department advice Government on the proposal to initiate Legislation with regard to :

 

(a)     The feasibility on the proposed Legislation from a legal point of view.

(b)Competence of the State Legislature to enact the measure proposed.

(c)The requirement of the Constitution as to obtaining the previous sanction of the President thereto.

(d) The consistency of the proposed measure with the provisions of the Constitution and in particular those relating to the Fundamental Rights.

 

11. Law & Judicial Department is to be consulted by all Administrative Department on:-        

 

(a)  the construction of statues, acts, regulations and statutory rules and orders.

(b)  any general legal principals arising out of any case.

(c)  the institution or withdrawal of any suit, prosecution or legal proceeding.

(d)  all correspondence to High Court or Supreme Court in any matter.

(e) matter relating to State Judicial Service.

 

   1.3    Duties.

                       1. Compilation, Maintenance and Interpretation of all Acts/Rules, Laws and regulation in force from time to time.

2. Administration of Justice in the State (Incl. Dist. Council Courts and Training of Judicial Officers).

3. Advice on Legal Matters.

4. Appointment of Advocate General Standing Counsel/Public Prosecutor and Government Advocate.

5. Advice on all cases involving the State of Mizoram in the Supreme Court, High Court and Civil Court to the Department and                 Agencies concerned.

6. Vetting of all Official Bills/Rules/Regulations.

7. Contract deeds and Arbitration Cases.

8. Matters relating to inheritance of property under the Mizo District (Inheritance of Property) Act, 1956.

9. General supervision over Infrastructural development of the Judiciary.

10. Lushai Hills Autonomous District (Administration of Justice) Rules, 1953.

11. Personal Laws and Customary Laws and practices.

12. Matters relating to High Court.

13. Investiture of Magisterial Powers.

14. Matters relating to Legislative Assembly.

15. Motor Accident Claims Tribunal.

16. Registration of Marriage.

17. Separation of Judiciary from Executive.

18. Matters relating to the Mizoram Judicial Services. Establishment of the Institution of Lokayukta in the State of Mizoram.

 

With Reference to Section – 4 (1) (b) (ii) of the RTI Act, 2005

 

2.         Powers and Duties of its Officers and employees.

 

                  There is no distinct power or duties invested upon the Officers and staff of the Department apart from the normal power had by Officers of other Departments of the Government.

 

With Reference to Section – 4 (1) (b) (iii) & (iv) of the RTI Act, 2005

 

3.         All decisions are made in the Department through collective endeavours by step by step movement of files.

 

With Reference to Section – 4 (1) (b) (v) of the RTI Act, 2005

 

4.         All Employees in the discharge of their functions adhere to all Central rules and regulations, instructions as adopted by the Government of Mizoram.

 

With Reference to Section – 4 (1) (b) (vi) of the RTI Act, 2005

 

5.         The Department maintains records of the Acts & Rules published by the initiative of the Department. Besides the above, Register of Marriage within the State of Mizoram is also maintained by the Department through the Registrar of Marriage.

 

With Reference to Section – 4 (1) (b) (vii) of the RTI Act, 2005

 

6.         Concerned Department is not akin to other Departments where policy or Implementation thereof is required. Hence, arrangement contemplated under this sub-clause is not in existence.

7.         Under the Administrative Control of the Department, the following authorities/committee exist :

1)Office of the Ld. Advocate General, Govt. Advocates, Public Prosecutor, Standing Counsel, Panel of Advocate in the Supreme Court, High Court and Subordinate Courts.

2)Mizoram State Law Commission constituted under the Mizoram State Law Commission.

3)Office of Registrar General of Marriages.

4)Mizoram State Legal Services Authority.
